Last Friday’s opinion by the D.C. Circuit Court of Appeals was a profound blow to Big Labor’s aspirations to achieve card check through use of regulatory action (see blog Card Check through Regulation vs. Legislation), especially after the re-election of President Obama and recent decisions by the pro-labor NLRB to extend Big Labor’s political money pump (see Pro-Union NLRB Primes Union Money Pump! ). Card Check, Big Labor’s most coveted prize, is the Gasping Dinosaurs’ only true means to survive and avoid extinction. Big Labor not only needs favorable NLRB decisions to allow Card Check-type benefits through ruthless Corporate Campaigns, but it also needs unfettered use of membership dues to influence politicians and maintain its grip on public sector employees while it rebuilds its membership in the private sector. The President, through recess appointments of radical members, was determined to pay back his Big Labor buddies for their major role in his re-election. The recess-appointed NLRB members have been intent on carrying out this mission!

Thankfully, the three branch system of checks and balances created by our founding fathers performed as designed, and thwarted the President’s attempt to Rule by Fiat, as the D.C. Court of Appeals overturned the President’s unconstitutional power grab (see  Appeals Court Nixed Obama’s Recess Appointments.). Although this decision primarily affects judicial decisions made by the NLRB, it is truly the tip of the iceberg with respect to the impact it has on the NLRB’s ability to create an environment conducive to Big Labor’s Persuasion of Power  utilized during Corporate Campaigns to force businesses to capitulate, to bypass the secret ballot election, and to force union representation upon employees through the ruthless method of  Card Check! This decision, in the interim, may for all intensive purposes “handcuff” the NLRB operations, as they will most likely be hesitant to move forward with future decisions and regulation changes until the appeal process is exhausted. Ultimately, so long as it is not overturned by the United States Supreme Court, the decision could shift the balance of power on the board, as the ruling severely restricts recess appointment of future board members as chronicled in the following article!

“Friday’s opinion of the D.C. Circuit found that this interpretation of the Recess Appointments Clause is incorrect.  Instead, the D.C. Circuit held that the President can only make appointments during “the Recess” of the Senate, which the Court interpreted to mean the time between official sessions of the Senate, as opposed to any significant break during a legislative session. These “Recesses” – i.e. time between official sessions of the Senate – often occur only at the end of the year and for a few number of days, if at all.  Accordingly, this interpretation severely limits the opportunities of the President to make recess appointments and allows the Senate to prevent recess appoints from occurring by never officially adjourning sessions of the Senate.

This alone would be a significant departure from current and prior administrations’ interpretation of recess appointments, but the D.C. Circuit added an additional wrinkle by holding not only that the President can only make appointments during official recesses of the Senate, but that these appointments can only be for positions that become vacant during the recess.  The prior understanding of the Recess Appointments Clause was that it allowed the President to fill any position that was vacant at the time of the recess, not just those that become vacant during the recess.”

This brave and thoughtful decision by the D.C. Court compliments actions by the United States Congress (see Congress Fights Back! Recent NLRB Power Grab Takes the Center Stage… in Court! ) and other courts to reign in the out of control pro-labor NLRB and to protect employees across the nation from forced unionism.

In May of 1993 America was in the midst of a recession brought on by a progressive entitlement mentality, which was preceded by unprecedented growth of the U.S. economy during the Reagan years. While not a common term in the early 90’s, but openly used today, the term “social justice” has proved to be nothing more than another code for the entitlement mentality. The effect of this mentality would prove to have negative implications on American’s and the American economy for years to come.

At the time, a survey was conducted by USA Today which I responded to concerning the perspective of small businesses and the economy. It was apparent to me at the time that our government did not learn from the failed policies of the 1970’s and was attempting to return to a progressive “social justice” theme at the expense of the economy.

I responded to the survey, not just by answering the canned questions, but included a two page letter as well. It was evident then and it is evident now, the notion of “social justice” as achieved through entitlements does not work. Despite his progressive nature and his wife’s attempt to pass universal healthcare in a stagnant economy, Bill Clinton was the beneficiary of a revived economy. The economic state of the nation at that time was revived when the Republicans regained a majority in both the House and Senate during the 1994 mid-term election, and they were able to successfully force Clinton to reign in welfare and entitlements in order to balance the budget.

We now have a President who is more radical than Clinton and wouldn’t have a clue how to manage a lemonade stand, much less the United States of America. He is a “social justice” apostle. With support from his “big labor” buddies and other far left radicals, such as George Soros, the President continues to push forward his endeavor to destroy the free market system and replace it with socialism. The ultimate goal is sameness for all. It is easier to herd sheep when they are complacent. Now the sheep are at the trough once again, but unlike in the Clinton era in 1994, there is no one present to control the big bad wolf!

Please read my Letter from May 27, 1993 and see if you don’t agree that America has once again regressed and there are no restraints to keep this president from utilizing executive orders, regulations and the democrat majority in the senate from pushing us over the “fiscal cliff.”

Now think deeply and honestly about where America once again stands! The government is deeper in debt than ever before – roughly $16 Trillion in debt, unemployment hovers at 8%, approximately 47% of Americans are on some type of entitlement, businesses are fighting to survive and the President and his minions want to increase entitlements and raise taxes on the most productive members of society!

As Thomas Jefferson stated, “To force a man to furnish contributions of money towards the propagation of ideas which he disbelieves is both sinful and tyrannical.”

As was true in the early 90’s, there currently is no incentive for Americans to work hard, to act responsibly, and to rely on their own self determination. An even scarier scenario is that this President could realize his goal of collapsing the American economy and rebuilding it as a socialized society, unless Americans wake up soon. Much like Greece and Rome reached this point in their history, America is at the tipping point! Unless Americans wake up and regain the self-dependency demonstrated by our forefathers who shaped the greatest nation that the world has ever known, America will suffer the same demise! God help us!

Ironically, the United States of America is now 236 years old. Be Afraid. Be Very Afraid America, We are at War! Armageddon is at Hand! Please Wake up!

It is time to call a spade a spade. The Big Labor thugs continue to show their true colors by attacking one of America’s most sacred holidays, Thanksgiving! The Big Labor Bosses, a.k.a. Gasping Dinosaurs, have their own selfish interests at heart, working to save their lifestyle, political influences and ultimate power. These tenacious tactics all come at the expense of the very members they claim to represent! Shame on Them for using this special occasion to further their own agenda. In connection with their buddy in the White House, on the very day that celebrates the Pilgrims Awakening to the reality that socialism does not work and free enterprise and free markets are the only true path to prosperity!

In their quest for survival, the Big Labor Turkeys are willing to destroy American exceptionalism and execute the most devastating and effective portion of their so-called Corporate Campaigns against American businesses. Simply put, their actions are an attempt to reduce business revenues during this critical fiscal season. This effort to bring businesses to their knees and submit to forced unionism comes on one of the proudest days in American history.

Mirroring the attacks against my company, as chronicled in The Devil At Our Doorstep, the goal is to publicly embarrass and intimidate businesses into capitulation. Big Labor shares a motto with Saul Alinsky, “Ridicule is man’s most potent weapon.” Simply put, that is what these outlandish and unpatriotic demonstrations are all about!  The Shame is on Them, not on the businesses that have led this country and its people to be the most prosperous in the history of the world!

The recent atrocities Big Labor has inflicted and planned to inflict upon businesses across the country during this holiday week are nothing short of a disgrace! First, we watched the Twinkie debacle, where head of the Bakers Union – Frank Hurt, despite desperate pleas from the rank and file membership, let his ego make the decision not to negotiate with Hostess and sacrificed 18,500 jobs. Instead he stood by the union mentality of power and intimidation, which forced Twinkie Maker Hostess to Close, costing 18,500 Americans their jobs in this stagnant economy!

This week, the UCFW and their partners in crime decided that Thanksgiving and token “Black Friday” was a perfect opportunity to apply pressure to Wal-Mart’s employees, whom they have been attempting to force unionize over the past several years. Their strategy was for a Black Friday walkout and picketing of Wal-Mart stores across the country. This would be an attempt to publicly embarrass Wal-Mart, but more importantly reduce their revenues during the most important time of year for the retailer. The union claims that this walk out was in response to Wal-Mart opening late on Thanksgiving Day and forcing employees to give up their Holiday and return to work.

These same type claims were made against EMS during the SEIU’s Corporate Campaigns! The SEIU were experts at finding disgruntled employees, which every company has as some people are never happy, then use these people and coercion and intimidation to reinforce the ranks. They then use these people to process the campaign of Death by a Thousand Cuts and engage the sympathetic and oblivious mainstream media to support them!  What the mainstream media fails to realize is that these people are a very small minority. Case in point, when the SEIU realized that its campaign against EMS was failing, it called upon EMS employees in a last ditch effort to strike on Labor Day weekend. The result was that approximately 10 out of 400 employees in Indianapolis went on the picket line. You do the math, less than 3% of EMS employees, and half of them were union salts!

Despite the fact the National Labor Relations Board (NLRB) and its radical Obama recess appointees will do everything it their power to favor Big Labor, all charges against EMS were dropped by the NLRB Administrative Law Judge who noted the claims were unbelievable, contrived and without merit! Similarly, Wal-Mart employees have already come forward and admitted that Wal-Mart only provided the opportunity for employees to choose to work if they desired. Typical that Big Labor depicted this as “forcing” employees to work against their will, using the gullible and easily mislead recruits to attempt to verify its position! I am sure the NLRB, which is desperately attempting to achieve Card Check through Regulation vs. Legislation  will do everything in its power to assist the newly reelected President by repaying his Big Labor buddies and bring businesses across the country to their knees!

Keeping up their destructive reputation, our old buddies the SEIU decided this was the perfect time to make life miserable for California travelers on the biggest travel day of the year by Striking the LAX Airport in attempt to disrupt travel and impact airport vendors and airline revenues! Another selfish attempt by this radical union to place survival ahead of respect for a national holiday and American citizens! In most cases, like the protestors at LAX, the people picketing are not even employees of the company, but hired guns brought in to create a disturbance and get media attention. Shame on the SEIU Fat Cats!

Americans must stand up on this great day in history and ask themselves are these the type people we want determining our destiny through their “puppet” President in the White House? The answer is NO! This collective group is responsible for the immenent Decline of American Exceptionalism! Stand up America and take our country back. When the going gets tough, the tough get going! After all, this is an appropriate time of year to establish peace and American prosperity!

Hurricane Sandy was one of the most devastating storms in recent history and inflicted unimaginable damage and suffering to Americans on the east coast, particularly in New Jersey and New York. One would think this would be a time for Americans to rally together to support fellow Americans devastated by this ferocious storm. This should be a time for differences to be put aside for the greater good of restoring essentials services to people on the east coast. However, the Gasping Dinosaurs, better known as Big Labor Bosses, think only of themselves, and believe as Raum Emmanuel did when he infamously stated “never waste a good crisis.”

Big Labor’s true colors were on display when volunteer crews from Alabama traveled to New Jersey to help restore power for millions of people and were told by representatives of the International Brotherhood of Electrical Workers, “Don’t Help with Sandy Unless You’re Unionized!” It is incredible that Non-Union Utility Crews from Alabama were Turned Away From Helping NJ Sandy Victims, but even more incredible, was that the President of the United States never said a word about these events. President Obama is fully aware that his re-election hinges on Big Labor’s support. Money is the source of power for Big Labor.

This distressing behavior is typical of Big Labor, and President Obama, as well. The naked truth is they only care about themselves and will use any opportunity to further their own cause, such as the President’s recent “tour” of New Jersey, which was nothing more than a photo-op designed to make him look more “Presidential.”  The effort to improve poll numbers was made at the expense of those who truly need assistance.

Collectively, Obama, his administration, and Big Labor have one objective — survival. They will use any means of misinformation, intimidation, deception and coercion necessary to achieve their objective. These “survival skills” have proven to be Obama and Big Labor’s Common Ground!

As chronicled in The Devil at Our Doorstep, President Obama and Big Labor are partners in crime, utilizing the Death by a Thousand Cuts approach to achieve their goals. These opportunists will stop at nothing and will run over anyone who stands in the way of achieving their objectives. This clear Persuasion of Power is graphically illustrated in Big Labor’s Election Intimidation Factor, where union members themselves revealed how they were coerced and intimidated into voter recruitment for President Obama’s re-election campaign and other Democratic candidates, against their will.

It is no secret that Big Labor spends more than three times as much money on its Foot Soldier “ground game” as it does in direct contributions. It has also been apparent in Obama’s recent campaign speeches, as he exhorts people to “extract revenge” (see New Romney TV Ad: “Revenge or Love of Country”  and Obamunists Seek Revenge on U.S.). The President and Big Labor bosses understand that their ground game and attack mode is their last hope of survival and they have no intention of backing off. In fact, breaking news exposed that sheet metal Union Members were Caught with Truckload of Stolen Romney Signs in Ohio. It is obvious that they are desperate, and “desperate people do desperate things,” as evidenced by their recent actions!

Actions speak louder than words, and as you go to the polls to vote, remember the recent actions of the President and Big Labor bosses! Do you really want a President who supports these type actions? It begs the question, “what is their real agenda?” Based on his past affiliations with Bill Ayres, Saul Alinskey, Reverend Wright and others, Americans should Be Afraid. Be Very Afraid! America, We are at War! Armageddon is at Hand! Please Wake up and vote “NO” to Obama and his Big Labor handlers on November 6, 2012!

The attachments to this blog truly speak for themselves! They have been received from people around the country, including both union and non-union employees, who are outraged by Big Labor’s Gasping Dinosaurs attempts to steal the election for its last hope of survival, President Obama.

Keep in mind as you review these materials that if an employer utilized similar tactics towards their employees, as those used by the labor unions, the employer would be crucified by the mainstream media! Have you heard or read about any of these tactics by Big Labor in the mainstream media?

Most likely not! There are two potential reasons for this.  Either they are philosophically in sync with Big Labor, or they are terrified Big Labor will attempt to eliminate the media outlet’s revenue source: its advertisers!

The following is a sad commentary on what a certain group of people are willing to perpetrate on other people to achieve their objectives and survive! All names have been removed to protect the innocent.

You asked me to write a summary of my experience with the Union Representative I spoke to Wednesday, Oct. 3 or Thursday, Oct. 4 in the atrium of the 1515 S Street building.

Entering the atrium I noticed several Union staff at tables talking to people, I asked one what was going on and she told me they were there to encourage members to vote NO on 32 and Yes on 30, we don’t want what happened in Wisconsin to happen here. To my right were probably 8 large covered aluminum pans, after inquiring as to what they were for and what was inside, I was told I could have a burrito IF I filled out a card saying I would vote NO on 32 and YES on 30.  Because I wanted to see how this played out, I asked for a card. After been given the card, she actually pointed to each of three line items, telling me to check each box, which stated how I would vote.  The card asked for my name, address, email and phone number. At the very bottom of the card it asked for my birth date.  I asked why they needed my birth date and she told me it was to verify my voting.  I was shocked. “Verify my voting on what?”, I asked. We need to verify you are the person written on the card if we cannot read your writing, the birth dates help do that. (This card requested our signature and our printed name.)

During this process I mentioned how I didn’t want my dues to go towards any campaign funding. She said something about a specific clause preventing that from happening; I told her I checked the box at the bottom of the membership card notifying the Union of my request not to use my dues for political funds. She told me they weren’t.  I ask, “When the Union tells its members they spent over 450 million dollars on election campaigns during a previous election, I find it hard to believe they didn’t use my dues, especially when they cannot produce a printout of names of members who do not what their dues used for this purpose.”  She strongly reiterated how they are not using my dues for campaign funding IF I checked the box on the card.

I wanted to experience first hand how they handled the signature/promise to vote NO and YES pledge card issue, I felt like they were bribing members to solicit votes in their favor. As a member, I bought that burrito, no matter how I choose to vote.  Otherwise, don’t bring the burritos at all.

And, furthermore, I do not believe my dues are exempt from political campaign funding. There is not enough transparency of our Union budget, it should be on the SEIU website, or a printout made available for members or the public to view anytime at the main office.
